This is crazy im a huge Marvel fan if they do fix it in the future i will repurchase it, but for now, straight to refund it goes

It's not a you issue. There are many posts about this happening. I've built PC's for years. I've had this one for about 2 years now. I've had little to no crashes at all. I've had more crashes with this one game since it's release then the entirety of the lifetime of this PC, yet every other game I play works fine. It's the first time I've had to give a negative review simply because of how often it's crashed on me.

Did you try setting DLSS to the highest performance setting before entering sleep? That would have reduced the amount of required video memory.
These issues are not affecting everyone, but unfortunately they do affect some players. Nvidia users have been reporting more issues than AMD users.
