You unlock the ability to recruit in Act 2, so just move along the main storyline.
1. If you kill them they dont come back.
2. Story quests are story quests...

3. Feel free to kill them but it's mostly up to you what do you want. The game opens up once you reach and conquer Rhun (with the ability to travel everywhere and conquer other forts).
The ability to dominate a captain comes in one of the missions in Cirith Ungol if I am not mistaken.
Also, killed orc can sometimes come back but they will always be replaced by new orcs once the time advances (finishing a mission, advancing time at Haedir stone).
Oh yes, I am stupid, Rhun is the one south of Lone Mountain. Nurnen is the one in Mordor (also, it is quite a bit smaller) :D
