If they kill the survivor, town doesnt have to worry about losing due to its vote. Jailor also doesnt lose his executions if he executes the survivor so theres no detriment to him executing the survivor.
It's sort of an inherit balancing issue with the survivor. Unless the town hinges on having that extra vote, the survivor is more likely to go against town than for it.
Actually, I found out that being Amnesiac and claiming it, is actually working a lot better than claiming Surv as Surv, because baddies rarely claim Amne, and Invest really see you as an Amne if he invests you. That's why I prefer to play Amnesiac than Survivor (even without remembering a role).
As it stands, there is really no reason for town to keep a survivor claim alive, which in turn causes them to always side with evil folks, and then town doesn't trust survivors because they side with evil folks, which is because survivor is always lynched by town... etc. It's this sort of looping logic that makes survivor a harder role.

then there's the part when most survivors want to side with mafia so they just kill them off anyways
