But yeah... on topic; I don't know personally if he'd approve or not, but... I imagine if you credit Scott in the begginning sequence of the game it shouldn't be an issue, since you claiming all characters and what-not are copyright of Scott Cawthon. And if you're not making a profit from it, then you should be golden.

That'd take more money on your part than it's worth :c I personally would just make it a digital download, instead of an actual physical copy. But if I were you I'd check with Scott before all else, just to be sure. Better safe than sorry ^ ^;
Oh gosh D: Sorry that happened to you :c Maybe Scott has his own personal reasons for not wanting fan games. In all honesty I don't blame him. Not that there's anything wrong with fanworks, but if a fangame boosted in popularity, free of charge, that might damage his profits. He has a wife and kids to think about, so, I can't judge him for that.
But yeah, it doesn't hurt to ask. He can either approve or deny, it's ultimately up to him in the end.
I think the problem with your game that was shut down was that in the end it would have been a free version of the game with even more content than the original. So people would get that version instead of the actual game, and it would hinder Scott's business. I'm not sure how he feels about Fazbear Entertainment, but the FNaF3 fangame is pushing it and I wouldn't be surprised if it got shut down.
The thing is that it doesn't have any of the extra content or easter eggs the original game has, and it requires 4 other people to play with you to get a similar experience.
