That's the whole point he is designed to be annoying. Deal with it.
Foxy can activate when set to 0 if 21+rand=D (rand=5, D=26; rand=4, D=25; etc.).
Foxy doesn't activate on Night 1 because D is constantly set to 0 the entire night. Otherwise, D is manipulated to cause Foxy to become more or less active (add for more active, subtract or set to 0 for less active). This makes Foxy more active if the Freddy head is used unnecessarily or if there haven't been any animatronics in the Office for a while. It also makes Foxy less active when the flashlight is shined down the hall.
