Go to ... Program Files (x86)\Steam\SteamApps\common\Star Wars Empire at War
Right click "runme.exe" and "runme2.exe" and change the settings in both to
"Run this program in compatibility mode for Windows 7".
Also check the boxes...
"Run this program as an Administrator" in both.
Do the same for any appropriate MOD files, but for sure this is a confirmed issue with the base games.
I did everything what you said but now i schows me an exception and the game crashes again :/

figured it out! There is a key within the registry that controls the refresh rate of your monitor. Mine was set at 75 and I could not change it within FoC. So I edited the key back to 59 and it works perfectly - even with mods, and NO windowed mode needed.
Reigstry key:
HKEY_CURRENT_USER\Software\Petroglyph\StarWars FOC\Profiles\Profile0\Player
Key to edit:
ScreenRefresh
(change from 75 to whatever is best for your monitor)
Thanks to JockGit for the tip!
which service pack? i can choose the win vista service pack 1 or 2 or which one do you mean?
