I wonder if starting a new game in the enhanced version will trigger the new policy agreement?
I'll try that when I get home from work.
I can confirm that it worked for me: launch GTA Legacy Online and the first thing it asked me was to accept the privacy policy. I also use the Steam version and I haven't played online since I tried it once back when the game was released.

edit - They did this on legacy, from within the game I believe. Isn't hard to literally test all the way to get into online. The 'story' or 'online' choice at launch has been a joke since release since most would go into story, and then into online anyway.
Equally, you can disable battleye in the R* launcher / settings, or using -nobattleye in the launch options if you wish to not install it, but to try to get it to trigger online policies, before savegame migration.
