In most people's playthroughs he gets caught, one way or the other.
The problem is, it's hard to keep track of what gets reset when Max jumps into pictures and changes stuff, and the nightmare sequence blurs things even more. -_-
Still, the general consensus is that Mrjeff gets caught.

Either Chloe is murdered by Nathan who get caught, then Jefferson get arrested, probably on Nathan confession, or Chloe and Max share their investigation with David and Jefferson is caught after he murdered Nathan. He is caught in every ending.
