In my game, Max asks Jefferson for some water. He complies, bringing over service cart in the process. Then he hears Madsen come in, grabs a tripod and tries to ambush him; Max screams out a warning, David suffers a glancing blow but stays in the fight. Max kicks the cart so it strikes Jeff from behind. He runs over to a closet to grab his gun; Max has to kick over a lamp so Jeff trips over and is finally subdued by David. Afterwards, he lives until the trial unless you tell David that Chloe is dead (in which case he shoots his captive).

If you tell David about Chloe and how Jefferson killed her he goes insane and kills Jefferson which would earn him a prison sentence because an average citizen does not have the power to kill even someone like Jefferson unless it is in self defense.
Because then David would get arrested for murdering Jefferson...
