I can't say for sure one way or another. However, a good rule of thumb is to turn off the music while you do a let's play or review. That is usually where people get in trouble the most. I personally had a video contested there at Youtube over the music during the video (and I don't even monatize)

I contested their decision to force me to delete or mute the video and was able to get it over turned. However, I was lucky. I did not get a strike against my (Youtube) account.

If you are curious to know who it was that contested the video. It was Sony.

Hey there,

Yes, you're good to monetize our videos :)

Have a read of this blog post from the Tomb Raider blog[tombraider.tumblr.com] - the same policies apply to our western IPs, including Sleeping Dogs:

No Commercial Use: We don’t permit our materials to be used to make money or to gain any other financial benefit. That means you can’t sell our game content as if it were your own, and you can’t use it to help sell other products or services. Similarly, you can’t use Square Enix materials if you require a paid subscription for people to view it or you otherwise make money or some other financial benefit from it. However, we don’t mind if you monetize via advertising through partner programs like YouTube.com, Twitch.tv, Ustream.tv, or similar video sharing services.

Something to bear in mind though:

Only Square Enix Music: Some of our games contain music that we don’t own and merely license. Usually you’ll be able to recognize this (such as the radio music in Sleeping Dogs), but we understand it won’t always be clear. As a result, your video could be subject to automated filtering by the owner of the recording or composition. If you’re unsure about a particular song, please check the game credits. Since we cannot grant you a license to use someone else’s music, you’ll need to get permission from the copyright owner(s).

Wow. I almost stepped on my wang. Good thing I read what the developer wote before opening my big fat mouth!

Actually, allowing users to montize gameplay "footage" is a very clever sales ploy. While monetization is not acceptable under the Fair Use act, allowing users to generate interest in the game by allowing fractional infringement (but, actually, it's not infringement when copyright holder permits use) without any real monetary cost to copyright holder…actually may help to fatten the bottom line, widen the profit margin.

To be clear about this, it's ADVERTISING through legitimate agents, not misappropriation of proprietary rights (I was being somewhat hyperbolic with my "allowing infringement" comment).

I get this often with a lot of games. Screen will be black, white or ignored. So instead of Window capture I make the game windowed, make the resolution around the size of my screen and select Display capture.
