How do Scavenger Crates work under the new gear system?

Is it like the old gear system where I should wait till Rep 3 with a Warrior to open crates, or can I open them any time and have a chance at Legendary gear?

All of them can comeback one prestige earlyer but extreme rare.

• Heroic Tier: Rep 3 - Rep 6
  
• Epic Tier: Rep 5+

Speculation is that with Season 3's changes, Epic Tier will stop spawning after Reputation 8. Legendary Tier will likely begin spawning at Reputation 7, so we'll see something like this:

• Common Tier: Rep 0 - Rep 2
  
• Rare Tier: Rep 1 - Rep 4
  
• Heroic Tier: Rep 3 - Rep 6
  
• Epic Tier: Rep 5 - Rep 8
  
• Legendary Tier: Rep 7+

So if you want to maximize your scavenger crates, you'll have to wait until Reputation 9 to use them.

However, remember that the higher you go in gear tier, the lower the marginal improvement. So it becomes a question of time-value at that point: Would you rather hang on to the crate until Rep 9 to maximize the per-crate return, or would you rather use it earlier (say, Reputation 5) to get a significant immediate boost?

I swear I could've seen someone with a different rarity at some point though.

That's... Not possible; gear score doesn't show up on the loading screen anymore (I don't know if you can check someone else's any other way).

If you saw their gear score numbers in a kind of blueish turkoise colour, that's because once you hit the max gear score, the numbers turn from gold to blueish, despite still having legendary/gold gear.
