*Billing does not occur until item is available for download
*Downloads are not eligible for returns or credits
(This line makes it hard to get a refund once the game is available to download)
*Pre-order low price guarantee "Pre-order any product and if the price drops before the release date, you will be charged the lowered price. You won't be charged for your digital pre-order until it is available for download."
(This line can be argued with if the $5 buyer insist they get their game)
At the time of posting it no one had paid for anything. Even now many charges are just temporary holds on funds (I'd like to say they all are with online banks not differentiating between the two properly on the statements but can't say 100%)
The price guarantee doesn't cover mistakes. It's just there so if the price drops (legitimately drops) before release date you are not punished for preordering early.
Again though, no final decision has been made. Just pointing out that these are not defenses.
The only possible mistake would have been GameStop mistakenly applying their Saints Row franchise deal to the new game yet to be released.
Whether or not that is an actual mistake, and whether or not they'll honor the deal if it was a mistake, is yet to be determined.

GameStop PC Downloads Return Policy
RESOURCES
Having a problem with your purchase? GameStop values your business and we have all the information required to help you find the support you need:
SUPPORT / RETURN POLICY
While GameStop makes every attempt to ensure satisfaction with your purchase, all PC Download sales are considered final. It is the responsibility of the buyer to know the system and compatibility requirements of a game prior to purchasing. If there are technical issues that prevent access to your game, our support team must be contacted prior to seeking a refund. Please see the above link to our support portal for more information.
If after working with our support team it is found that the issue is unresolved, at that time you will be provided instructions on how to submit for an approved refund. Please note that in some cases you may be required to contact the publisher to resolve support concerns that are specific to that publisher's software, and in some cases refunds cannot be approved for a publisher related issue.
If you experience any problems ordering, registering an account, receiving a product code, or using your new software, please visit the above support portal and reach out to our support team. If your transaction appeared successful but you did not receive your product code, please do not re-order as there may be an email or routing issue, and re-ordering could result in a duplicate charge.
While we are usually much faster, please allow 1-2 business days for a response from our Support Team. We recommend reviewing our support portal at the site listed above to find answers to frequently asked questions while we review your request.
Please Note:
While every attempt is made to ensure you have the full enjoyment of your purchase, all refund requests are subject to GameStop approval and could be denied at any time.
Refunds requests due simply to not meeting system or compatibility requirements (ie: slow game play, poor video quality, etc) cannot be approved. It is the buyer's responsibility to know computer system and compatibility requirements prior to purchase.
Refund requests on credit/debit card orders must be submitted and processed within 90 days of the transaction to be considered.
Refund requests on PayPal orders must be submitted and processed within 60 days of the transaction to be considered.
Every attempt is made to process refunds within 5 business days of receipt, but may take up to 2 weeks to process.
Refunds cannot be offered for Massively Multiplayer Online (MMO) games.
Refunds cannot be offered for games published by Electronic Arts or Bethesda.
Pre-purchases on unreleased titles (if not published by Electronic Arts or Bethesda) can be refunded up to 5 days before the release of the game by contacting us via email through our support portal. Note: If a pre-purchase game offers any content including beta access, bonus content or games, or any other offering with pre-purchase prior to launch, refunds cannot be offered.
Somebody is getting awfully defensive by whipping this return policy text out. Unfortunately there are a bunch of holes in it. LOL
In the end though, there's nothing the user can do. If gamestop choses not to sell it and either drop the charge (so the authorizations/holds never go through) or even reverse the charge. And if they either never hand out keys, or have the Publisher revoke the keys, that's it. End of Story. Bad PR for Gamestop and the Publisher, but it's happened before. It's just whether or not the PR hit or the money hit is worth it for them.
