If you are referring to campaign, you need to level up your general to level 15 in the ardour (blue) skill line. Just mouse over the level 15 ardour icon, you will see it in the pop up.
There are other ways to do this as well, e.g. if you conquer all of Fenkhu regions, you can get an ancillary called standard of Fenkhu. Equip this on a general and will unlock the option for night battles as well for the general using it without the need for leveling up. Same standards can be obtained for Iswa, Thrace and Western desert regions.
Ah I see... I was wondering where night battle goes
I think there's also meant to be one in the Dynasties system itself, but I haven't seen it first hand.

Yeah i think the Dynasties system may also do this as well. Think it depends on the type and level of dynasty you have as in the (red) warlike one. Dont have a save currently to verify that though so happy for others to correct me if this is wrong.
