So is Upper Deck trying to say they own the word Legnedary based on that DMCA notice you posted?
That is stupid if it is.
Is this some sort of US of A ability to own a word? Or is this a reflection of how under staffed and lazy Valve is that they just allow a blanket tAke down of anything with that word from a company DMCA request.
As for the "US of A ability to own a word", that's known as a trademark. And, yes, Upper Deck does have a registered trademark of the name Legendary for its card game. The problem with their action is that trademarks are not covered by the DMCA (only copyrighted media is). Even though filing DMCA takedown requests solely based on a potential trademark dispute is technically illegal; fighting a DMCA takedown request could still involve further potential legal problems.
