Nobody is saying you used the *actual* track straight off the soundtrack, but the cue heard in your trailer is note for note the same as the Tron: Legacy theme. It's like if I played the Superman theme myself in a homemade composition and called it my own. Seriously, listen again if you still doubt it:

Not trying to be a butt, but that is more than "similarities", come on. At least it seems like you've already reached the same conclusion yourselves as there was no trace of it in the second trailer, even if you won't admit that here. Just keep in mind just how nerdy your audience is for the future... ;)
All that aside, very much looking forward to the game, it looks amazing. :D
