You have to actually have seen one or know an empire that has the tech. Also, you really want your physics researcher to be a particle expert, a curator or to have either the maniacal/spar of genius traits, otherwise you have a much lower chance of seeing it.

If you mean Gateways and not L-Gates, you only need to either find any Gateway while exploring, or make contact with an empire having one in its borders. Then the activation tech is still required for the construction tech, but not having or activating it yourself.
Having the Gateway in your borders increases the chance for the activation and construction tech to appear by factor 4x.
Discovery traditions and a Particles Expert employed will increase the chance by another 1.25x each.
A scientist with Particles, Maniac, Genius, or Curator traits is pretty much required, otherwise the chance is reduced by 90%.
Example Psionic Theory requires either a Psionics Expert or Maniacal scientist (among other things), but a Curator or Spark of Genius don't help. It is just highly inconsistent and arbitrary.
