2. the penalty is 10% energy and influence production for every point over you are (I forget where that penalty caps, if at all. may be 50%)
3. having a system in a sector causes it not to count towards your core system limit, but allows the sector AI to manage the planet.
there are several options for what the sector is allowed to do with planets that you can enable and disable at will. most are pretty self explanatory

Also does going over the cap affect happiness and in case the Ai manages the planet do i still get the bonus from its spaceport to my fleet limit?
you still get full benefit from spaceports
