Commercial license?
I am allowed to use my creations, with the instruments inside the program, for commercial purposes?(like music or sound for games)

5. Using the Software and Contents for commercial purposes

5.1 Software
In principle, the Software may be used for commercial purposes. The only exception to this is the product "Web Designer" (not "Web Designer Premium"), which may only be used for non-commercial purposes.

5.2 Contents
a) In principle, the Contents - with the exception of Live Sets - may only be used for non-commercial purposes. This also applies to music, video or photo data as well as the corresponding templates acquired through or by means of MAGIX Products.

b) The Contents included with the products "Web Designer Premium" and "Photo & Graphic Designer" may be used used for commercial purposes within the scope of a website or the creation/editing of one's own photos and graphics. A transfer to third parties for commercial purposes (e.g. within the scope of contractual work) is not permitted.

c) Exploitation of Contents outside the scope of personally created work, i.e. separate from the work results achieved with the Software, is prohibited in all cases. In particular, the photos contained in the templates may not be extracted and used separately. This applies to both commercial and non-commercial uses.


They say in 5.1 I can use the software for commercial purposes, but in 5.2a they say if I use the contents i can only use for non-commercial purposes.
In the definition of contents we find:

1.3. Within this agreement, "Contents" refers to those Contents which are included in a MAGIX Product in addition to the Software, such as music files, video files and photo files, as well as other sounds and templates that contain such files.

So the instruments are defined as contents?

or better say, Can I use this software with the instruments songs for create musics or songs for a commercial game?

i am sure , that if you write or make your own sound effects
using the soft-synth synthsizer , or play your own MIDI keyboard ,
playing any melody that you made up , is YOURS .

if you buy a piano , and you write and play your own song .
the piano company has Nothing to do with what you made with the piano .

do NOT use any provided image samples ,
do NOT use any provided video samples .
do NOT use any provided .wav sound loops .
do NOT use any provided sound samples
do NOT play someone elses melody .

then you have FULL rights to your music and sound effects .
it is your 100 % original work . you could even copywrite it .

see section 5.2c
"personally created work" is the Big Exception .

You can't use someone elses songs\song fragments for your Comercial use .

but you can write your own songs , and play them with the built-in
soft-synth synthesizer . that song is YOURS , for any Comercial use you want .


side note :
if you were going to use any provided sound samples , then you might as well
"Lift" sound effects and music from an already published game or movie ,
and use that in your Comercial work .( you wouldn't do that either ) .
if someone could prove you Lifted their sounds and music , then you
would be in deep .

get a mic , and record our onw Squeky door , running water , bird cirps ,
gulp gulp drinking , pouring water into a glass , etc ,..then those are ALL YOURS .

use the soft-synth synthesizer , any of the instruments and Sound Effects .
we buy the synthesizer , in the same way someone buys a Piano .
apply reverb\echo bandpass filter to make a new uniqe sound .
use multiple frequencies to make a more robust sound .
( do NOT use someone elses audio )
