Here's some examples:
Discord client modding: You can modify the Discord client to allow plug-ins and custom themes and so long as you don't abuse the API you won't get banned, and before you ask yes Discord is aware of it, and no they haven't done anything besides warning people against it on Twitter and Reddit.
Genshin Impact: You can use custom models in GI and there are no reports of people getting banned (Note: People have been banned from HSR which is by the same developer, but there haven't been any ban reports in years) there's also other mods like ReShade, FPSUnlock and the Dawn Linux patch (depreciated). I highly doubt that Mihoyo isn't aware of GI mods but they haven't done anything about it.
That being said, you can still add the very same mods you had before, but the process is a bit more involved. Look it up. I haven't bothered to do it myself yet, but you can.
2. At least you admit the "got away" part. I.e. there's no argument here that doing this is simply wrong. Because it is wrong to dodge the shop in the game where monetization is built on that shop.
3. Finally, just because someone else does something wrong somewhere else, doesn't make anybody entitled to do so here as well.
