Malice aura from scepter inquiry

My weapon gives me the aura Malice. I see it in my G skill menu but can't tell if it's working. It's greyed out with an exclamation and it states not enough spirit BUT I still see the red aura around the feet of my character (for some reason the buff icon doesn't appear even though I have it enabled in settings). As a test, I remove one of my minions to allocate more spirit for Malice but nothing changes because I still see the red aura around my feet, however the icon in the G menu is not lit up with no exclamation. I can't interact with button at all or drag it or anything so I assume it's just supposed to be on permanently. Obviously I want max minions so how can I tell if it's actually working when it's greyed out with exclamation but the aura still appears around my feet? Is there a test like standing next to a mob to see an icon or something. Not sure why there's no buff icon on the top left regardless if I remove minions or not to give more spirit.
