So Not sure where he was. It just seems odd. Only thing I can think of is they incarcerated him, until he was willing to do what they wanted and whereever it was (Any number of choices, most likely (Can't remember the name of the big city in II)
- They pick up the Marstons about four years after American Venom (RDR1 is 1911, RDR2's epilogue is 1906), arresting all of them for crimes committed during RDR2
- They ship them to Sisika Penitentiary off the shore of Saint Denis for processing - this is likely where Abigail and Jack stay the entire game; potentially Uncle, although some dialog suggests they just overlooked him
- They ultimately make a deal with John, "hunt down the remaining members of the Van der Linde gang or we'll kill your family"
- They ship him with Ross and Fordham to Blackwater and put him on the train from there to Armadillo to track Bill Williamson, the last area his gang was known to operate in
With the exception of Abigail and Jack being incarcerated at the Penal Colony, and them overlooking Uncle, we'll go with as the most plausible.
Charging Abigail with something is the most likely scenario. There was concern she was one of the likely informants in II. She was there at the scene of the Pinkerton Slaughter at that one town near the end of the gang. So she could be charged with their deaths as an accessory after the fact.
They apparently completely ignored Uncle, I checked - it was likely they had nothing to hold him on. Alternatively, he wasn't written to be a part of Dutch's gang in RDR1.
