Yes they can, but legally that can’t distribute it as it violates copyright laws

And Obraxis has stated to NOT distribute a mod that ports below zero content to subnautica

There's a nuance. You can mod it for yourself if you own both games. You just can't distribute it to others.

That's BS. It's absolutely up to UW to allow people to redistribute their own content. It just wouldn't be very smart to allow them to do that.
