I guess for games and conversion mods, it would fall under the "fan fiction" section. In such cases it probably would be better to ask for permission rather than forgiveness if something bad happen.
Embracer Group paid 395 million USD for the rights to make LOTR and Hobbit games. So they might get an evil eye as well.
Just because TaleWorld seems to give modders free reign to do as they please with the game, even create some bastardised online mmo of it, doesn't mean IP holders of various fandoms do the same.
