The 2 points they miss on are points 2 and 4.
Like most Starwars games, it ends up largely darkside or lightside, the one area I fault the series is the rather lack of a neutral or grey area.
I would also suggest a playthru of Last Of Us, simply cause while the story is rather set (it misses point 3 of your criteria) the storyline is most definately in that moral grey area and the protaganist (debate on whether to fully call him one) is most definately a flawed character that suffers.

It's an indie/kickstarter title that is currently in beta, slated for a fall/winter 2014 release. I wouldnt get the beta to play the game in its current state, best to wait for the final release, but its worth keeping an eye on.
A zombie apocalypse RPG that is heavily story driven, your choices on what you do with your group of survivors does impact the game, good or bad, plays similar to classic X-Com/Fallout turn based strategy. Tons of character customization, itemization, etc.
I would recommend a game that I like far more. Dark Souls 1. It is just a masterpiece. The moral greyness is probably the only thing that it shares in common with TWD. But it is also a brutal but free-form RPG. Completely packed with smart design.
Might want to have a controller on hand though.
I honestly think it's the best series at character development around, it's like saying give me a good shark movie but not Jaws.
I actually played that one, and just want to add, pretty awesome start to the storyline as far as intial catayst of events.
I actually still have my PS2 disc of it.
