If I catch a boss after max level, does it start again from level 1?

To obtain more dark skill points you need to finish the game quest line, after that you will rebirth to the start with more dark points than before.

on dark skill points it states 1/12 max... does this mean I can only have 12 dark skills maximum ever? or is there a way to obtain all the dark skills?

You only obtain 12 at most, but each rebirth you can reallocate the invested points.
