Sin and Punishment yes, as Nintendo co-developed it.
Mischief Makers.....hard to say. It's possible SQEX has it, given Enix published it in Japan, but who knows. I doubt Nintendo has a hold on it like you're implying.

Mischief Makers should be alright (I would love them to create HD sprites). Sin and Punishment won't be possible.
MM's graphics are still pretty good even today. Personally I would like to see an HD version of Sin & Punishment with a higher polygon model for the playable character.
Fortunately, Sega is very accommodating when it comes to licensing out their IPs. Devs have gotten the rights to work on recent releases of IPs like Shenmue, HotD, Panzer Dragoon, Wonder Boy, and Streets of Rage 4 without Sega even as a publisher.
