Legally it is., but only during its own minigame.
Maybe there are some mods on Nexus which allow control it in freeroam, maybe.

TY. I just want to make sure I dont need to buy a DLC or whatever
There was a mod for it on Nexus but its not there anymore

No. It is a dlc included in the complete edition which is often on sale for $5.
