It will be 9. There's no reason to skip Coco.
If Hitomi Chris wasn't part of Gen 1, Rushia won't be part of Gen 3. Cover doesn't want contract breachers to be brought up when the talents play Holocure.
Also there have been way too many Coco easter eggs in the weapons/items at this point, it would be weird to skip her now.
A fan game usually under the mercy of the copyright holder for sure, regardless whether it's a relax company like Hololive or just straight up Nintendo.
For me personally, I don't think there is a problem in copyright in adding graduated members, even Chris. But to be fair, adding Chris is like throwing gasoline into fire in term of alienating fanbase, so I just made up a hypothetical scenario that won't work. Rushia will totally be added in my belief, despite of incidents in her last moment of Hololive's career. There is no wrong in using past talents, unless it's too touchy and too controversial, or lack of information.
I'm not opining on whether she should be included or removed, by the way. Based on how the character was treated (erased) by the company after the talent was terminated, I'm predicting that Cover doesn't want anything to do with the character anymore.
I doubt they'll rescind the fan license if Kay Yu decides to add her against their wishes, but it's a sure way to get in bad terms with them.
