Even their official agreements have been contested over the years, especially when EA acquired the property.
Although the problem with that is EA will most likely get all butt hurt (being a bunch of kids and all) and sue.
You can definitely use the SWG installation from steam (through your library) to play SWGEMU, I did it myself last week. It's pretty fantastic.
Also, they're non-profit organizations. They don't benefit from running these services.
They're fully playable now, bugs get fixed regularly. Content gets added regularly (I believe they're at update 6). The server is always at least 1/2 full (often near 75%+). There's no 1.0 official release, it's a constant stream of content and bug fixes from a very dedicated and knowledgable developer staff.

just a quick note, 1.0 is still the offical goal of the SWGemu although theres alot done and theres alot of fun to be had catching up with past friends and relearning the old game and helping if able with time or donations or both, The goal is to get to 1.0.

The SWGemu will be done when the devs feel they have done all they can to achieve re-creating SWG as of publish 14.2 it is still an alpha development state project, the fact that it has more to do than most finished MMOs these days and is fun to play is just a bonuses and a testament to the awesome systems SWG had/has.
You should study copyright and trademark law. Trademark law could careless about the infringing parties status. Also go look at how not for profit organizations are set-up you may find the answers you were unaware of. I am just saying, don't kid yourself.
There is no trademark etc being breached, players are playing with content they own on the games original disc or steam install. This has been argued no end and there is nothing anyone can do to shut the emu down as no profit is being made from it and people are using a product they own.
