Now I'm non the wiser in this regard.
Is recording game-play and posting it on youtube legit or not?
Is any audio the game itself produces and is part of the recording legit or not to post on youtube or do I still need permission separately by the singer/songwriter?
Sure I can simply re-record the sound but I only want to really do that if I'm actually in the wrong not because google simply says "computer says NO".
Do any of the game devs know anything or have any experience with those type of youtube claims/issues?

Loop 6 is matching the music in-game.
I'm assuming the game devs have bought the tune and are aloowed to use it.
But do I need to buy the tune myself now as well if so I don't get into trouble by youtube because the game plays this tune?
It's only $19.90 so I might just buy it so I can tell youtube to get lost.
I have a think about it but would obviously prefer some input from someone with some experience in that field first :)
As content matching is an automated process youtube would not even know they are lying.
If anything then the money for adds should going to the game devs and/or the actual producer of the tune (linked in y first comment).
AddRev claiming it instead is theft...no?
It's companies like AddRev who send in a huge amount of Royalty free tracks to youtube for automatic matching, As youtube does that through an automated service AddRev is auto-claiming copyright and no youtube employee ever sees that.
If you contest, youtube will send the contest request to AddRev,..who,..guess what...deny your complaint. Ones your have a complaint denied you can try to contest again...however, as the complaint is automatically send again to AddRev, they off course deny it again.
Makes sense that youtube sends the complaints you make to the company that is wrongfully claiming ownership to accept or deny your claim,... no ? </sarcasm>
Problem there is youtube will then punish you for re-contesting and being denied a second time.
Punishment is anything from you are not being able to access your account for a period of time or not being able to upload new videos for a period of time.
The only way to contest is If the owner of the video does contact AddRev directly through a highly convoluted process on their web site. then AddRev apologizes and removes the adds.
This is how internet mobsters make money these days. Claim wrongful ownership, profit until someone complaints through the convoluted process, then apologies for the mix-up but off course KEEP THE MONEY earned during that period!
The sad part is while AddRev cash in the $$$$$$ the youtube channel owners have to let this pretty much happen and people who do not know any better blame the developers of the games for it (which is wrong off course as it is AddRev and their likes causing the problem)
Dangit Youtube.
There is a way around the gaming YouTube "trap" however: Make use of the Fair Use laws by making your video qualify as commentary or critique and you should be fine.
If your video qualifies as a fair use you have the legal right to monetize the video (as long as you don't infringe on any other copyright), defend yourself from Content ID claims and sent counter-notifications
Or just don't have the music so your voice is easier to hear if you are speaking for it as I find is better (I've been testing for making my own stuff).
How do you mena?
The song in specifically that AddRev claimed as theirs was one of the tunes by ckotty Corporate (well, according to AddRev and the tune does sound exactly like it):
http://www.pond5.com/music/1/artist%3Ackotty-corporate.html
Nonetheless, as far as I know, ones you purchase those tunes you can use them Royalty free in your development and commercial products and legally profit of those products containing those tunes.
That usually means that if you make a game-play video with that tune in it you CANNOT (legally) profit from that unless you also purchase the license for that tune.
However, AddRev has no right to claim it as theirs and profit of advertisements in your game play video as they have no clue at all if you did or did not purchase that license.
Off course, ones you sent them your proof of purchase and tell them to get lost they do apologise and remove the adds.
The immoral part in my opinion is that AddRev falsely "accuses" you and immediately actions add spam without checking with you. As long as you don't counteract they make the $$$.
AddRev does that with tunes you yourself create and they cannot possible own.
But if you don't complain they make the profit from YOUR work.
Apparently making profit of someone else's work is not illegal as long as you stop doing it and apologies when confronted.
There is something seriously wrong with the laws around this that allow youtube to let companies like AddRev do that. There should be laws making AddRev give the money back to the authors of the tunes.
