It's probably a bug and you should get another fine, not for littering but for selling before getting checked.

I haven't had that happen to me yet but I'd like to avoid it
I've seen at least one glitch where I had to fully shut down the game. I did reload after occurring the littering fine at Atlas prime, but still incurred the fine. I'm thinking maybe I should have shut the game down, restarted, and tried again.
He noticed that I sold some items before the check.
The fine still got declared as "littering"
Pretty sure that you shouldn't be able to sell before.
With reloading the game you might be able to cheese it though.
Edit: I reloaded the game to see what would happen if I didn't sell stuff off before weighing in. It wants you to surrender your items, and you can't leave until you do! Also, it doesn't seem to recognize my weight limit upgrade at the weigh station. I paid for the additional 220 lbs, which puts my trucks weight limit at 661 lbs. My trucks load is currently 1,148/661 lbs. (I found 3 salvage in 2 sectors!) But, the "Surrender Items - Summary" at the weight station says my Legal Weight Limit is 441 lbs.
