You can also send any prisoner currently in your prison to death row (I am not sure if there is a limit to the number of death row inmates a prison can have, except for the obvious number of death row only cells you have) using the same method. Clemency appeals, if they fail, decrease their clemency chance by 50%. So, for example if you have a DR inmate at 36%, he has that chance of having his sentence commuted at the Death Row appeal and migrating to the general population.
If he fails, that chance drops to 18%. Some 3 days later, he will attend another clemency hearing. If he fails that one, clemency drops to 9% (below the threshold, assuming you've researched the appropriate tech with your Lawyer).

(If you execute a prisoner when his clemency rate is too high, you risk a substantial fine.)
