What if you keep 'feeding' a lich rivens, then defeat them, could you end up with something like 38/30 rivens?
I don't see why that wouldn't be possible but I have to ask why would you do that? The game won't let you play Sorties until you have 30/30 Rivens or less.
Them stealing your loot is the incentive to not just leave them be and get it over with and stab their face. They are your nemesis after all.
Its the part of the nemesis experience.
If you don't want to participate - then don't run generic 20+ grineer levels, do not kill the larving and most importantly - do not stab it with parazon.
The entire thing is opt-in so if you don't like it - don't participate. If you want those guns - you participate and you accept the rules of the nemesis-game.

A bit flawed though. For everything "single" there is only a chance that the lich grabs it. So you may hit your riven capacity anyways. So you need to unveil/sell/transmute rivens anyways. At which point the Lich may just be holding the most tasty riven you got given that you "need" to work on them anyways.
