Hah unfortunately I spoke too soon. While you are able to steal it and use it, it breaks that encounter- the enemies just go invulnerable and stand around, and don't drop the required quest item to proceed (I even checked their pockets with pickpocketing- nothing)
So yeah, as of latest patch, while you can DO it, it'll break your game.

okay, after more ♥♥♥♥♥♥♥ around with it, I got it to work. Key modifications were having my party !just! outside of the encounter activation range, my rogue ran in and grabbed it and teleported out, and then another party member immediately used and dropped the stone. Something else that I noticed was that conversation was actually started with my OTHER party lead (my rogue is 1 of my two "main" characters) but I picked up/used the stone with one of my followers.
