If you dont want people to leave when you go on rampages, you will have to pick up evil companions, like Dorn, Xzar, Montaron, Viconia, etc.
You can be evil in this game, but going around killing everyone you see isn't going to get you very far.
There is a D&D spell that lets you speak with corpses and spirits. Speak with Dead, if I recall.
BG2 is better in that case
None of the BG saga really supports intelligent evil play. Only stupid/♥♥♥♥♥♥ evil is allowed, except for the main villains.
or they visit a seer... licensed one, not some faker (like those in the carnival).
besides, if i was inhabitant of a fantasy world i would probably make mountains of gold just by hiding in the forest and reporting all villains-wanna-be to the flaming fist...
Divining someone's killer is really not that difficult. A 5th level priest in PnP could do it (by casting Speak with Dead). Might take a couple of corpses to get an answer though.
At the end of the day though the present system is there because of the difficulty in inserting any realistic alternative.
Like having chickens as witnesses, like in Skyrim?
