Changing Difficulty
You don't seem to be able to change game difficulty at will. Looks as if you have to start another game from scratch. Is this true? Thanks.

no never used to be like that can change on settings when in game

You can change the difficulty in the options menu UNLESS you chose Legacy of Bhaal difficulty at the start (but in that case you probably won't have any progress that could be lost).

You click options, use the process of elimination or deduce that difficulty falls under "gameplay" and not under "sound" or "graphics", read what's on screen and adjust the difficulty slider as desired?

If you need even more help you can also toggle story mode in the same menu.
