1) You accept to help her, so you've to kill the Flaming Fist officier. AND you instantly loose 2 reputation point by having Viconia on your side.
2) You don't accept to help her. The result is she turn as an enemy and attack you.
Blame the game. Not me. This is how it's scripted.
It's been awhile since I did a playthrough with Viconia, but IIRC she does tell you what happened in BG2. Although, I can't remember the details.
However as a Paladin, after you hear the guard's story and cast detect evil on Viconia, you would be justified in arresting her and executing her if she resists.
Ever hear of corrupt law enforcement? Chasing someone doesn't mean the person chased is evil or did something wrong. Also, question the Flaming Fist and he says "It's obvious she's evil, she's a drow." She's drow, so automatically evil? What about Drizzt Do'Urden? Sorry, murder at worst, or wrongful execution at best, wouldn't sit well with a Paladin at all. In fact, you can question the Flaming Fist asking what crimes she's committed. To which he replies to what I stated above (or something similar).
Lawful Good doesn't mean blindly following the Law. It's following the Law that benefits the GROUP (or sociey, or town, etc.). How is killing Viconia benefitting the group, in this case, with no evidence of wrongdoing?
Lawful Neutral would be an example of someone that obeys the Law regardless if it effects Good or Evil. "A soldier that follows orders is an example of Lawful Neutral...."
Yes you can help her, but deny her entry into your group. You are not forced to accept her. A Paladin wouldn't refuse help, so option 2 isn't even a valid choice, really if you're roleplaying.
It was shortly after she arrived on the surface. She was being attacked by goblins and a caravan merchant, thinking her a surface elf, had his guards drive them off. He agreed to take her with him, in exchange for some of those "Drow arts." She traveled with the caravan for a time. One night his heart gave out, but the guards accussed her of murdering him.

"Selling" her to the flaming fist officer. specially on those grounds is not all that good really either. And there used to be an option to kind of shame the guard into going away for persecuting her just for being different from what I'm remembering. It's been a long time since I've done it. So maybe I'm remembering wrong or perhaps it was a high charisma option.
