WoW has millions of active players and it's probably the most well known mmorpg out there. Marvel heroes on the other hand never had a massive player base, not many people ever knew about it either, it's a pretty obscure game. No one would put up a private server even if they'd have the source code. You can count the faithful players of Marvel Heroes by the hundreds, on a private server there would be even less active ones. It's not worth the hassle or the risk unfortunately. Plus it's a totally different situation here, Marvel can ♥♥♥♥ their life pretty good if they'd ever try something like that, they're one of the biggest corporations on earth, you wouldn't to that either if you were in their place.

not to mention the big ddos hitting them in response every time they sued somebody (probably not if it's just to shut something down people expect that but demands for money would be asking for a heap of trouble they don't want), and the hefty trolling of all of their social media profiles on top of the flack they already got over battlefront 2 by gamers and of course pissed off gamers look for validation and those little lovebirds from both games could come together and give them a small pr ♥♥♥♥♥♥♥♥♥ briefly. and for that particular brand, any ♥♥♥♥♥♥♥♥♥ is a bad ♥♥♥♥♥♥♥♥♥. How the ♥♥♥♥ does disney end up with a marvel video game anyways? Have I either woke up in a bad episode of the twilight zone or sliders when disney owns so many video games from comic and sci fi companies that have nothing to do with cutesy characters and such? garsh. weird ♥♥♥♥♥♥♥ corporate climate these days in the entertainment industry.
I got to do a couple of betas for this one, and it was such a different game in it's first year. It had a lot of flaws still, but was a fun experience. It's sad to see this happen. I may as well download it one more time, especially now that I see it has controller support, and finish my story run with Gambit before I lose the chance forever I reckon. This is not on disney btw, nor most of the lower level devs in gaz. It was one more case of upper level mismanagement yet again, especially once they lost the diablo guy.

This doesn't really apply, theres private servers of lesser known games like ran online, gunz the duel (Even if gunz 2 exist) and a bunch of others (Just visit gtop100 or xtremetop100) which are very healthy
Actually your example is the one that doesn't apply, because the ones you listed may be obscure games with private servers but they don't have a corporation as big as Disney behind them. Disney has a net worth of approximately 150 billion dollars, to give you an idea of how much that is I'll give you a few examples. Valve is worth around 5 billion dollars (more or less), even Activision Blizzard is worth far less at around 40-50 billion, EA is worth 30 billion, hell Disney is worth as much as my country's nation brand. Please tell me more about how would it be healthy for anyone or their families to get sued by such a massive company and ruin their life entirely just so a few hundred people can play some game that was average to begin with. I don't want to offend you but your request makes no sense and seems childish. I mean don't get me wrong it's sad to see a game die and I'd like it to live on through private servers but it's not that simple.
What about Toontown online and Pirates of the Caribbean Online? Both obscure multiplayer games with private servers that has Disney behind them.
You're missing the point completely, the games you mentioned are fan made recreations using publicly available downloads and information. The original devs have nothing to do with any of them. OP was saying the MHO devs should release the "server code" and I was debating on that point. Of course if fans would create a private server on their own with files that are already public, the repercussions from Disney wouldn't be that bad but if the devs do it instead and directly violate their contract, it would definitely have extremely bad consequences.
Are you guys very young or something? Don't you know how awful it is to get sued? It is a pain to get sued even by one person who has no legitimate claim on you, because even then it takes a lot of time and money to get it settled. Let alone by Disney who's got armies of lawyers paid with hundreds of thousands of dollars each. It would totally destroy their lives, it's not worth it.
