an private server? learn some proper english, but to answer your question, yes, yes i do because there is still nothing being done with star wars private servers and old disney abandonware games alike. they are still current and active servers. in theory, they could take action but this would more than likely be in the form of a simple request to take the game down with a warning. i've seen this several times in the past and it ends peacefully. quit fear mongering people. lastly, i've read plenty into the situation and it was because it was a huge game with a specific company working on the game, they wanted money, plain and simple.

Beyond that, you'd need to do your homework in terms of where to host it publicly. If that couldn't be done they either keep it secret, like the CoH guys did, or leak the code in a manner that wouldn't trace back to them. Then let others try to host it somewhere it couldn't easily be taken down.
