Private server.

So not going to name any names but there is interest in starting a private server as a few people still have the backend code for this game. The question is.........Will there be players? Regarding copyright issues it turns out that if a game is shutdown and auctioned off all its assets its freeware after 3 years. So.......anyone interested?

that sounds far from correct, plus marvel still holds the copyrights to each of those heros and villians so legally to setup an private server would not be so legal, its possible someone could do it but if it came to light it could be hit with an takedown notice.

there is various terms like freeware, abandonware, but that doesnt mean they always apply.
and thanks to disney copyrights tend to last 15-50? years i think and can be reknewed.

there is probally an bunch of games which have had there code taken and used to create private servers, though thats not always legal.

the EULA is only forcible by gazzilian by denying you access to the retail servers and services, but a court case is most likely not happening as well, there gone. Now if marvel/disney wanted to sue, they could but they haven;t done that for starwars galaxies. Regarding what i posted earlier about copyright law, i forgot it differs from state to state, country to country. Where the servers are being planned to host its not illegal after 3 years to bring back what some consider abandonware. Yes you are correct that using the likeness of characters without licensing can get you in trouble, but consider once again starwars galaxies and how many private servers they have without being sued, i think we can do what we darn well please with a game that comes from a developer that no longer exists. Also since there not planning on charging for any of the services and its a labor of love not profit i think you guys have no room to talk. Considering the first thing i asked, its only hypothetical as a question so report all you like.

Shut UP & TAKE ME MONEY!!$!$! I've dreamed of when they do a private server of this. Played a lot other Private servers games. Been dieing for this to return. Had half the roaster at 60 before it went down. I don't know what it is about this game. But Best Dungen crawler I've ever played.

do what you will but fan projects are being shutdown all the time
fusionfall retro which had cartoon networks blessing got an dmca from them recently which led to its shutdown.
but there is an good chance that an dmca takedown notice could very well come
as it usually happens when stuff like that comes to light to the companys.

Last I'd heard, nobody had the server code for the game, since most Gaz employees were fired without warning and then locked out of the building.

Even when this is maybe my biggest gaming wish ever, the real problem is the copyright of the Marvel brand, so don't take unnecessary risks for you or your acquaintances

I dream of a private server or anything that allows me to still play Marvel Heroes. Best Hack'n Slash, created by David Brevik, Diablo's father, in the Marvel universe (not to mention ghostcrawler, Ryolnir and the others) ... what more could you ask for? It's also fun to see that Diablo 4 will take back a lot of basic marvel heroes when they didn't want them for diablo 3 (online mode, boss in the pex areas etc)
Disney could make an effort to make this legendary game for us, personally I don't care about their game made by square, or about marvel ultimate alliance which is only there to show the characters of the movies, not to mention their mobile games ... I'm a real comic book fan and I miss my x-23, my Jean, my psylocke ... etc.
Ok Gazillon made mistakes, and again that doesn't really concern Marvel Heroes, except for the console adaptation, but the game should never have been treated like that ...
If Disney had anything to do with us, they would have already saved the game rather than let third-party companies bought the bases of Mh when they could not do anything without the operating rights of Marvel ... except a version without the characters we love so much.
