Logically, it should already be included in the game. Some people are experiencing errors when adding New York to the game. Writes what you need to buy.
You can always issue a return if you are not satisfied with something.

It's included for people who buy it now but didn't use to be, that's the reason it is still sold separate.

I'd say, if the title of the game in your library states that it's included it should be accessible. Never mind whenever you purchased it. But it's probably that typical UB practice trying to persuade those that can't play the DLC to get it.
