Suing over intentional NDA breaches costs them lots money and gives them nothing tangible in return. It doesn't reverse the opportunity the actor may have took from them. In fact, it's liable to generate you further bad press. Not hiring the actor ever again costs them nothing, and will not offend most fans of the series.
