Report a translation problem
Tried forcing v-sync with d3doverrider and the catalyst control center.
Of course neither actually worked.
Also tried changing my refresh rate to 59 to see if that'd do anything.
nope.
The screen tearing is so bad it gives me a headache to look at. I can't play this game like that.
It's been out for a while now so I hope it won't be this way forever... I've lost money to unplayable games too many times.
I'll tell you what, definitely going to try games before buying them much more often....
I was really looking forward to playing it too :(

edit: also have my fps capped to 59 when v-sync is on. could be the source of both our problems. I've never seen a game cap at 59 rather than 60 on a 60hz monitor.
The vsync option was just added this past week, and we didn't see any issues when we were testing. It'd help if either of you could email me at dave@retroaffect.com and then we can actually look at what's causing this.
Also, I've never used d3doverrider, but Snapshot doesn't use Direct3d. All of our rendering is done with OpenGL, so it might not do anything for you.

From my point of view, the most strange thing is the fact, that your game seems to be capped at 59 fps. And that's, as I assume, the source of all problems with stuttering.
I hope that you will find solution to our problem soon!
We're still looking into what's causing the issue. Once we know what it is and have a fix, we'll post an update.

Turning full screen off makes v-sync work for me just fine with any resolution I pick.
No screen-tearing at all when in windowed mode.
For everyone else, if you wish to play in full-screen without screen tearing then fortunately there's a solution. Borderless windowed mode. Looks the exact same as full screen but is windowed. Some people prefer this for the conveniences of windowed mode without losing the full screen picture.
Snapshot works great with ShiftWindow.

Run Snapshot. Open ShiftWindow.
Put checkmarks in the "Window" sections options and select Snapshot. In the "Shift to" section put a check in the coordinates as well as the "set client size area" and then put in your resolution. Hitting "grab" might get what you want for you.
Put anything you want for the rule name like oh.. maybe Snapshot?
Select "trigger it"
Bam.
For those of us who prefer borderless windows this is great and for all the people that want to play the game in full screen without screen-tearing then this will do the job as well.

I just tried windowed mode as you suggested here and it worked for me to. The tearing stopped. Both with vsync on and off. Unfortunately, the game started to lag badly when I changed to windowed mode. I had to lower my resolution to a 1152x720 box to get rid of the lag. But I rather play in a windowed 1152x720 resolution then with the bad tearing I experienced in fullscreen.
I have Windows 7 and ATI Radeon HD4850 with the latest drivers from the Steam "Check for Video Driver" utility.
Also, in the continue screen my custom controls don't work, I have to use the default WASD. And when I enter the continue door, the game screen minimizes and pops back up again really fast.

EDIT: When I open it in Windowed mode, it runs normally, fast and responsive. But if I switch it to fullscreen and enable V-Sync, it goes back to 30fps. After that, nothing else I do brings it back to full speed, I have to restart the game (in windowed mode).
EDIT: Ok, after some more experimentation (aka playing the game :) ), I've found out that the game's framerate can drop anywhere, even when standing still such as the new game/continue screen BUT can also momentarily go up again and very quickly going back down to 30 fps. My graphics card is and ATI HD5730M btw.

8 GB of RAM

I'd suggest the dev add a fake fullscreen option (borderless window) if the problem is too hard to fix for whatever reason.
In fact many games use the fake fullscreen approach nowadays...
