this game uses RAGE, rockstar advanced game engine. the only AAA unreal engine 5 game on steam at the moment is Immortals of Aveum, but you'll need a very high end PC to even run it on low/medium specs and hit 60fps constantly. the key differences between UE5 and UE4 are lumen and nanite, aside from those technologies (which have a huge performance cost it seems, just like raytracing does) unreal engine 4 and 5 aren't all that different.
Max payne 3 was a game that came out in the awkward 2011-2014 period when games were pushing realistic lighting and materials but physically based rendering was still around the corner, a lot of these games haven't aged particularly well in my opinion. I think max payne 1's visuals have aged far better. Unreal engine 4/5 was not an option when the game was in development.
