I'm not.
Even secondary-damaging skills/spells (like damage from Avenging Angel or prolonged poisoning) may score a critical hit at any point. Not to mention basic magic like "magic missile" or "fire arrow". Happens constantly, so I can only assume there is a base value for theese.
(spells always score critical hits if the enemy is under the influence of the spell that cause every physical hit to be critical ... don't remember its name ... but that's not the issue, the issue is that spells can score critical hits nontheless)
I saw a stream on twitch where a guy was playing this game without the fire and ice dlc and christa's gift works perfectly, no bugs. So... um there's your answer.
It's easy to mod the data file to increase the cap, but unless you play as warrior you'll still have hard time getting enough XP for the amulet. Well, unless you mod that too, lol.
Increased control. There're two ways to reduce rest time - via Olaf's skill, which iirc doesn't affect valkyries' rage abilities, and via direct upgrades of the skills themselves. The latter, I think, does say "rest -X" when you select it, meaning rest time reduction.
Don't remember about criticals though.
