If you navigate to X:\F:\Steam\steamapps\common\sideway\Win32 and open ConfigCommon.ini, you will see a line that reads
; locks the game to 30 fps
MaxFrameRate = 30 .
Now setting this to 60 or 120 then saving it, will actually render the menus, intro movies, etc with an uncapped or capped at what you set framerate. [You can see it by using Fraps, MSI Afterburner, etc. I took 3 screenshots, 2 of which I uploaded to Steam showcasing +2000 FPS in the beginning cutscene. I use MSI Afterburner.]
So that takes care of 1, but the 2nd is the problem child. No matter what we set it to go at, when we load the actual level of the game we will see a beautiful dip of FPS right back down to 30. I have had this game since release, still no resolving or circumventing it unfortunately and I have been wanting to play this game again.
But yeah the game definitely has a great theme to it, just would of been cool if an engine update or some info was released to allow us to play it at the framerate we would have wished to.
Way to fail, developers.
It would be nice if this information was included on the store page, there are other important things that aren't mentioned on store pages like in game micro transactions, I wish they would standardize this information.
Right on! I didnt check it out before I got it. The 30 fps makes this potentially amazing game feel slow and really sluggish. To damn bad.

Just went from the R9 280 to a GTX 970. Tell me how! =D (instead of googling, I´ll just ask ;)
So, by coincidence I tested the game today and it booted up. So i figured I would test out the shadowplay fix, didnt work for me with 970. =/
