There are other ways. I already know certain individuals that have successfully extracted.
Trust me, I want to do the same just like everyone else. Hell since I've finally upgraded my computer I've had more reason to finally get back to working with UDK and U4, and had planed to look into Nosgoth for my own reasons.
But just like with nostralrius and every other private server that has been shut down without an okay from the IP's owner simply reverse-engineering and modifying the game has the potential of meeting the same result. One of the reasons I suggest rebuilding rather than simply modding since there's less chance of that happening.
There's right and wrong ways of going about it, just don't want something like that happening if any of us do make significant progress.
Correct, the files are encrypted, but just means it takes longer to go through depending on who's looking at them.

I'm sure there are quite a few who used this method while the game was still playable. If you ask around you can probably find people who wouldn't mind uploading the exported files to you.
There is no "legal jargon". DMCA stands for Digital Millenium Copyright Act and a DMCA takedown allows a copyright holder to demand any host remove copyrighted material under threat of lawsuit. You don't have to be making money off it for it to be illegal and copyright infringement, otherwise pirating video games and movies would be legal.
If you do this, you are basically asking a multi-national corporation who shut down the game in the first place to make profit to sue you for everything you have, and fair use won't protect you because you will essentially be using all the games assets which are the copyrighted property of Square Enix.
Believe me, I would LOVE to see this project happen and to have Nosgoth be modded to run on private servers or through peer to peer, and I'm on your side in this.
But sit down, shut the ♥♥♥♥ up, and stop acting like you know ANYTHING about copyright law because everything you just said there is about as ♥♥♥♥♥♥♥♥ as you can possibly get.
Square owns Legacy of Kain. They own Nosgoth. They own the games code and assets. If you try to use that and distribute it without their permission, even if you make no money off it, you can and WILL be obliterated by Square in the court room. They will start with a cease and desist notice, and you can either abide by it or they will sue you in to bankruptcy a thousand times over.
Nosgoth is gone. You are free to try to change that, but I promise you it won't end well for you unless you make your own game from the ground up using Nosgoth's concept as a base. Simply taking the game as it is and re-distributing a modded version of it will result in you getting in serious legal trouble. That is a fact.
