Maxed level heros (level 43) that you don't want can be used to upgrade the level of heros with good abilities but low level. If you don't have access to level 43 heros yet, you can still use higher level not-quite-max-rarity heros to upgrade the level of a target max-rarity hero. It will cost a bit less than a full upgrade, but I think you still wind up spending more total doing it in multiple steps.
The resultant level will be equal to the level of the LOWEST leveled hero you're using to upgrade them with.
I do not recommend the random-merge option. Just use the ampitheater to mass generate level 43 heros (if your civ tier is maxed out).
Be advised that the rarity upgrade is pretty expensive, as is upgrading a level 1 hero alllll the way to level 43. Upgrading from level 20 to level 43 isn't quite so pricy. You may find it easiest to just scrap all heros below whatever level your ampitheater currently generates, and then scrap all the commons.
