In focus is the unit in the center. You can see the three eye symbols which mark the area where "they are looking at". As long as your unit attacks that unit from an area which is not the same direction as those eye icons, it counts as flanking.
In your case it looks definitly... "wonky"? I would have need to check that specific unit you were attacking closer. But I can see why you wonder what is happening there.
Actually, when the unit has a Retaliation Attack ready those "eyes" are in fact "swords". You might want to differentiate between those while creating a guide.

There are some abilities, eg Defence Mode, that prevent flanking. There aren't a lot, but they're easy to do. I'd imagine every time you thought you should flank but didn't, that enemy had finished their previous turn by Defending instead of attacking/casting.
I literally wrote in my post that the Astral Serpent is not in Defense Mode, so you'd think I'm aware of that particular rule. I even posted another screenshot to prove that unit is not in Defence Mode since a crossbowman can "flank" him just fine..
Yes, but much more than that I'd like them to give an option to toggle the foilage showing. Counting those hexes in wooded areas is a pain. Or is it there and I'm just not aware?
I am not sure what you mean. When selecting a unit, whether your own or an enemy's, it shows kinda the range, making it easy to see the hexes. But yeah, sort of grid which makes it easier is missing.
No. You just can get stunned 30%
It's just a 30% chance to get stunned while attacking.
I mean, what I'd like is you press a button and all trees disappear. You release the button and they reappear. You often need to count hexes when for example positioning your army in defense and the hexes are hard to read when there's a lot of trees.
Ah, yeah. I agree with you. Sometimes I have had moved my units, thinking they would benefit from foliage, just to realise too late they missed it by a hex. And other times they were in foliage, but the foliage turned invisible when they are standing on it and I lost track of it.
I am quite sure i have all grids enabled.

You took those screenshots on different turns, didn't you? Could it be that the serpent used Shattering Refuge on the turn before the first screenshot, thus being refuged and invulnerable? Though I think there would be text indicating that on the tooltip, but I'm not sure.
