If that is "working as intended" then it is awful game design. Therefore I consider it a bug instead. The hero which got back into your recruitment pool - take them and have them run solo and get killed. That will refresh the counter properly and deal with the undead bug as well.
Example there's a vassal event about assassins, if you pick the option to send one of your heroes as bodyguard then he's gone forever, but the hero cap does not go down.
Interestingly that can be cured the same way. Recruit a cheap hero and have them killed against Marauders.
